Terms of Service

By accessing or using BookyTooky ("the platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the platform.

BookyTooky reserves the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform. Continued use of the platform after changes constitutes acceptance of the revised Terms.

BookyTooky provides an online platform that connects customers seeking to book spaces with venue owners who wish to make their spaces available. BookyTooky acts solely as an intermediary and is not a party to any rental agreement between a customer and a venue owner.

You must be at least 18 years of age to create an account or make a booking. By using the platform, you represent that you meet this requirement.

You agree to use the platform only for lawful purposes and in accordance with these Terms. You may not use the platform in any way that could damage, disable, or impair the platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

You may not share your account credentials with any third party. Each account is for a single user. Venue owner accounts may add team members within the limits of their subscription plan.

BookyTooky reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to the safety of the community.

When you make a booking, you enter into a direct agreement with the venue owner. BookyTooky facilitates the transaction but is not responsible for the performance of either party.

Payments are processed securely through our payment provider. By submitting a booking, you authorise the charge to your selected payment method for the total amount displayed at checkout, including any applicable service fees and taxes.

Cancellation and refund terms are governed by the cancellation policy set by the venue owner, which is displayed before you confirm your booking. BookyTooky's service fee is non-refundable except where required by law.

By listing a venue on BookyTooky, you represent that you have the legal right and authority to offer the space for booking, and that your listing accurately describes the space, its amenities, and its availability.

BookyTooky charges a platform commission on each confirmed booking, as stated in your subscription plan. Payouts are processed according to the schedule outlined in the Owner Dashboard.

You are responsible for ensuring your venue complies with all applicable laws, regulations, and safety requirements. BookyTooky may remove listings that do not meet our community standards or are reported as unsafe.

You may not use BookyTooky to: post false or misleading information; engage in fraud or deception; harass, threaten, or harm any person; violate any applicable law or regulation; infringe any intellectual property rights; or attempt to gain unauthorised access to the platform or other accounts.

Venue owners may not accept payments for bookings outside of the BookyTooky platform to circumvent our commission structure. Violations may result in immediate account termination.

To the maximum extent permitted by applicable law, BookyTooky shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of revenue, data, or goodwill.

BookyTooky's total aggregate liability for any claims arising out of or related to these Terms shall not exceed the greater of (a) the amount you paid BookyTooky in the 12 months preceding the claim, or (b) ₹5,000.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

We may modify these Terms at any time. We will provide at least 30 days' notice before changes take effect for material changes that adversely affect your rights.

Your continued use of the platform after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the platform.
